1. Scope

These Terms of Sale govern all purchases made within the Caresse mobile application, published by an independent developer reachable at admin@caresse.app.

They apply to all purchases of consumable credits and one-time purchases (lifetime unlock) made through the App Store (Apple) and Google Play Store (Google) platforms.

Use of the application is also subject to the Terms of Service.

Prices are displayed inclusive of applicable taxes directly within the app, prior to any purchase. They may vary by region based on local taxes applied by Apple or Google.

All payments are processed exclusively through the App Store (Apple) and Google Play Store (Google) platforms, under their own terms and conditions. The publisher of Caresse does not collect, store, or process any banking or payment data.

For any payment-related dispute, users must contact Apple or Google directly depending on the platform used.

4. Credit consumption

Credits are deducted at the moment an experience generation is triggered, regardless of the output produced by the AI. Since generated content is inherently non-deterministic, no credits can be preserved or refunded on the grounds that the result did not meet the user's subjective expectations.

Credits do not expire as long as the user's account remains active.

Technical guarantee: In the event of a proven technical failure attributable to the service (server error, interruption during generation with no content delivered), consumed credits will be automatically restored. Users may also report any anomaly at admin@caresse.app.

5. Right of withdrawal and refund policy

Waiver of right of withdrawal: In accordance with applicable digital content regulations, the 14-day right of withdrawal does not apply to digital content whose performance has begun with the consumer's prior agreement and express waiver of that right. By triggering a generation, the user expressly consents to the immediate execution of the service and acknowledges waiving their right of withdrawal.

Accordingly, no refund will be granted for the following reasons:

Refund requests for technical reasons (proven service failure) are handled as described in Article 4.

For any other refund request (accidental purchase, input error), users must contact Apple or Google directly, as they are solely authorized to process refunds made through their platforms.

6. Lifetime unlock — specific conditions

The lifetime unlock is a non-renewable, permanent purchase. It is linked to the platform account (App Store or Google Play) and can be restored on a new device or a new Caresse account using the "Restore purchases" feature available in the app.

If the account is deleted, access to the lifetime unlock within Caresse will be deactivated. It can however be recovered by creating a new account and using the restore feature, provided the purchase is still associated with the original platform account (Apple ID or Google account).

Consumable credits, on the other hand, are permanently lost upon account deletion and cannot be restored or transferred.

The publisher reserves the right to expand the options accessible through the lifetime unlock, including adding new features at no additional cost. No feature already included may be removed without prior notice to the user.

7. Account deletion and credit loss

Deleting an account results in the permanent and irreversible loss of any unused credits, with no possibility of refund. Users are encouraged to use their remaining credits before deleting their account.

Lifetime unlock access is deactivated upon account deletion but can be restored later using the "Restore purchases" feature (see Article 6).

8. Pricing changes

The publisher reserves the right to change the price of credits and the lifetime unlock at any time. Past purchases are not affected by subsequent price changes. New prices apply only to purchases made after they come into effect.

9. Governing law and disputes

These Terms of Sale are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing agreement, the competent French courts shall have exclusive jurisdiction.

In accordance with EU Regulation No 524/2013, users may also submit disputes to the European Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr.
